These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Cave Sight ("we", "our", or "us"), governing your access to and use of the PicPolisher website (http://localhost:3000) and services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND WAIVER OF CLASS ACTION RIGHTS, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

2. Service Description

PicPolisher uses artificial intelligence to generate professional headshots from user- uploaded photos. The Service is provided for personal and professional branding purposes.

We strive for high availability but do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts & Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are solely responsible for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.

4. User Content & Conduct

You retain ownership of the photos you upload ("User Content"). However, to provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, process, and modify your User Content solely for the purpose of generating AI images and improving the Service for you.

We reserve the right to ban users who violate these rules and report illegal content to authorities.

5. AI Disclaimer & No Guarantees

The Service utilizes generative AI technology. You acknowledge and agree that:

• Accuracy: Generated images may not perfectly resemble you. They may contain artifacts or errors common to AI (e.g., hand distortions, background issues).
• "As Is" Basis: The Service and generated outputs are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• No Professional Advice: Generated images are for creative use and do not constitute professional photography services.

6. Payments & Refunds

Fees: Fees for the Service are described on our pricing page and are charged at the time of purchase.

Refund Policy: We offer a 7-day satisfaction guarantee for first-time purchases, subject to fair use. Please refer to our Refund Policy for full details.

We reserve the right to refuse refunds to users who abuse the policy (e.g., repeated refunds) or violate these Terms.

7. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Cave Sight, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• ANY CONTENT OBTAINED FROM THE SERVICE; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

Some jurisdictions (including consumers under Australian Consumer Law) do not allow the exclusion of certain warranties or the limitation of liability for consequential damages. Accordingly, some of the above limitations may not apply to you.

8. Dispute Resolution & Arbitration

Informal Resolution: We want to address your concerns without needing a formal legal case. Before filing a claim, you agree to try to resolve the dispute informally by contacting info@picpolisher.com. We will try to resolve the dispute within 30 days.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Australian Capital Territory (ACT), Australia, without regard to its conflict of law provisions.

Jurisdiction: For any dispute not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the courts located in Canberra, ACT.
